SB698 (Motorcycle helmets. Provides for a $25 civil penalty for the conviction of a motorcyclist who fails to wear a helmet. At present, a violation is a traffic infraction and punishable by a fine of up to $250.) has made it out of the Senate Transportation Committee with a 10 - 4 vote.
Below are some of the talking points we are using to support SB698
* Brings a violation of 46.2-910 in line with the seat belt penalty
* Currently, a seat belt violation is a $25 civil fine, no court costs, no points
* An unbelted minor child is a $50 civil fine, no court costs, no points
* An improper helmet ticket is a minimum of $25 fine plus $65 court costs ($90) and the judge has the discretion to make it a $250 fine (it currently carries no points)
While this doesn’t give us back our freedom to choose whether to wear a helmet, it is one piece of a larger plan. How do you eat an elephant? One bite at a time.
